References in these Terms to "StayReservations," "we," "us," or "our" mean FP Labs LLC d/b/a StayReservations, the operator of stayreservations.com. References to "you" or "your" mean the person using the site.
By visiting stayreservations.com or using any part of the site, you agree to these Terms & Conditions ("Terms"). If you don't agree, don't use the site. We may update these Terms from time to time (see Section 16); continued use after an update means you accept the changes.
StayReservations is a hotel search and booking facilitation site. We help you find and compare accommodation options and, where available, complete a booking directly on this site through our booking technology partner.
Important — read this before you book: When you complete a booking through StayReservations, StayReservations is acting as a booking facilitator, not as the seller of the accommodation. Depending on the property and payment flow:
StayReservations does not itself charge your card, set room rates, or control cancellation policies. Where our Booking Partner is the merchant of record, your booking confirmation email will identify them and provide their contact information for cancellations, refunds, and disputes about the stay itself.
The price shown to you before you complete a booking is broken out as two line items: (a) the room rate charged by the Accommodation Provider, and (b) a combined "taxes and fees" amount, which includes applicable government taxes together with a service fee for use of our booking tools. Both line items are disclosed to you prior to finalizing your booking.
Service fees are non-refundable, including if you later cancel or modify your reservation, unless required otherwise by law.
Our service fee covers costs associated with operating our site and booking tools, including things like website operation, customer support, and facilitating your booking through our Booking Partner's checkout. These line items are currently generated and displayed through our Booking Partner's checkout system, which reflects what you're actually charged. You will not be billed any additional or separate amount by StayReservations beyond what's shown there.
If your booking is processed through our Booking Partner's checkout (hosted on our domain but operated by the Booking Partner's systems), you authorize the Booking Partner to charge your selected payment method for the total price shown at checkout, which includes the room rate plus taxes and fees as described in Section 3.
StayReservations does not store or process your full payment card number. That data is transmitted to and handled by our Booking Partner under their own security and privacy practices.
If a booking instead redirects you to a third-party site (such as an online travel agency), payment and the booking contract are completed entirely on that third party's site, under that party's terms. StayReservations is not a party to that transaction.
Cancellation and refund terms are set by the Accommodation Provider and/or our Booking Partner, not by StayReservations, and are disclosed to you before you complete your booking and again in your confirmation email. Some rates are non-refundable; others allow cancellation up to a stated deadline. StayReservations does not independently grant refunds or exceptions to these policies. To cancel or request a refund, contact the party identified in your confirmation email as responsible for your booking. If you're unsure who that is, contact us at [email protected] and we will point you to the right party or, where we reasonably can, help coordinate.
You must be at least 18 years old to book through this site. If you create an account, you're responsible for keeping your login credentials secure and for all activity under your account. You agree to provide accurate, current information.
You agree not to: use the site for any unlawful purpose; interfere with or disrupt the site's operation or security; attempt to reverse-engineer, scrape at scale, or decompile any part of the site or its underlying booking technology; misrepresent your identity or payment information; or use the site to make fraudulent or speculative bookings.
All content, design, trademarks, and other intellectual property on stayreservations.com are owned by StayReservations or its licensors (including our Booking Partner and Accommodation Providers, for content they supply). You may not copy, reproduce, or use this content outside of ordinary use of the site without our written permission.
The site may link to or display listings, rates, and availability supplied by Accommodation Providers or our Booking Partner. We do not independently verify this information and are not responsible for its accuracy, or for your experience with any Accommodation Provider or third-party site you're directed to.
The site and its content are provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose or non-infringement, to the maximum extent permitted by law.
We are not liable for: the acts or omissions of any Accommodation Provider or Booking Partner; errors, delays, or outages in listings, pricing, or the booking flow; or any indirect, incidental, special, or consequential damages arising from your use of the site.
Where liability cannot be fully disclaimed, our total liability to you for any claim arising from your use of the site is limited to the greater of (a) the amount StayReservations actually received and retained in connection with the specific booking giving rise to the claim, if any, or (b) $150 USD.
Nothing in these Terms limits liability that cannot be limited under applicable law.
We are not responsible for delays or failures in the site's operation or in any booking caused by events outside our reasonable control, including natural disasters, pandemics, government action, internet or telecommunications failures, or failures of our Booking Partner's or an Accommodation Provider's systems.
Please read this section carefully. It affects your legal rights.
12.1 Informal resolution first. Before filing any claim, you agree to contact us at [email protected] and describe the issue. We'll try to resolve it informally within 60 days.
12.2 Binding arbitration. If we can't resolve the dispute informally, any claim arising out of or relating to these Terms or your use of the site will be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small claims court if it qualifies. Arbitration will take place in Bernalillo County, New Mexico, or another mutually agreed location, or may be conducted by phone, video, or written submission where permitted by AAA rules.
12.3 Class action waiver. You and StayReservations agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.
12.4 Right to opt out. You may opt out of this arbitration agreement by sending written notice to [email protected] within 30 days of first accepting these Terms. Your notice must include your name and a clear statement that you wish to opt out of arbitration.
Your use of the site is also governed by our Privacy Policy, which explains what data we collect, how our Booking Partner and other providers may receive it, and your choices. That policy is incorporated into these Terms by reference.
We may suspend or terminate your access to the site at our discretion, with or without notice, including for violation of these Terms.
These Terms are governed by the laws of the State of New Mexico, without regard to conflict-of-law principles, except that Section 12 (Arbitration) is governed by the Federal Arbitration Act.
We may update these Terms at any time. Material changes will be reflected by an updated "Effective Date" above. Continued use of the site after changes take effect constitutes acceptance.
